UNIFORM CIVIL CODE - PROS & CONS
The issue of uniform civil code emerged because of the Muslim women's being adversely affect by their personal law and the supreme courts recent judgment on triple talaq.

The uniform civil code will replace the personal law of each religious community with a common set of law applicable or governing every citizen.

Our Constitution has a provision for uniform civil code in Article 44 as a Directive Principle of State Policy which states that - “The state shall endeavor to secure for the citizens a uniform civil code throughout the territory of India”.

PROS OF UNIFORM CIVIL CODE -

  • Equal Status To All Citizens - it will provide equal Status to all its citizens irrespective of their religion, class, caste, gender etc.
  • Promote Gender Equality - personal law of almost all religion are discriminatory towards women. Implementation of Uniform Civil Code will promote gender equality.
  • Boost National Integrity - India has a very diverse cultural values, but a uniform civil code, irrespective of gender, caste and creed will boost National Integrity.
  • End Social Evil Against Women - once the uniform civil code is formulated across the nation, India will undergo a major social reform and suppress the evils against women in this modern 21st century.

CONS OF UNIFORM CIVIL CODE

  • Threat To Communal Harmony - it is viewed by many religions as an interference of the government in their religion and believe that uniform civil code of aimed against their religious customs and value. If not convinced, these individuals can destroy the communal harmony.
  • Practical Difficult Due To Cultural Diversity - it is practically tough to come up with a common and uniform set of rules for personal issues like marriage due to tremendous cultural diversity.

The Union Law Minister has recently asked the Law Commission to examine the matters in relation to the implementation of the uniform civil code.
