ATTORNEY GENERAL OF INDIA ( ARTICLE 76 )


  1. A person who is qualified to be appointed as a judge of the supreme court - Appointed by the President of India - And hols the office during the pleasure of the President.

  1. First legal officer of the government of India - Advises the government on any legal matter - Performs any function conferred on him by the Constitution or the President.

  1. Attorney General of India has right of audience in all courts in the territory of India.

  1. Allowed to take up private practice in court, but not against the State.

  1. Should not defend accused persons for criminal prosecutions without the permission of the Government of India.

  1. He is prohibited to take appointment as a director in any company.

  1. Not paid a salary but a retainer that is determined by the President - The retainer is equal to the salary of a judge of the Supreme Court.

  1. He is assisted by - Two Solicitors-General and Four assisted Solicitors-General.

  1. Not a member of the either House of the Parliament - But is entitled to all the privileges and immunities as a member of Parliament - Except a right to vote in Parliament.

ADVOCATE GENERAL ( ARTICLE 165 )


  1. First law officer of a State - And is appointed by the Governor of that State - Holds office during the pleasure of the Governor.

  1. Remunerations are determined by the Governor - Must be qualified to be a Judge of the High Court.

  1. Has right to attend and speak in the proceedings of either houses of the State legislature - Without any right to vote.

  1. Has right of audience in any Court in the State.

  1. His office and functions are comparable to that of the Attorney General of India.
